Village Residents Asked To Conserve Water

$

Residents in one small village are being asked to conserve water for the second time in a month.

The Village of Jeffersonville has issued a “conserve water order” for the next two days, Wednesday and Thursday.

“Residents and business are strongly urged to not water flowers, fill swimming pools, wash their vehicles, or parking lots,” read a press release.

Earlier in the month lightning struck the village’s water plant causing a pump to become nonoperational. The village ran out of water 24 hours later but a temporary fix was made and the village was under a boil advisory for several days.

New pumps are being installed today and tomorrow at the water treatment plant, thus the reason for the order.

“The conserve water order is being issued to prevent another boil advisory,” the release read.

In a time when graduating classes across the region can boast of success stories, Abbey Flory is a Success Story. Officially.

The Ohio Department of Education is recognizing her as one of sixteen graduating seniors who are Career-Technical Education Success Stories for the class of 2013.

Flory, a Live Oaks Career Campus student from Amelia, is a student in the Digital Arts and Design program. She has earned college credit and industry certification, and had her choice of attending the Savannah College of Art and Design or the Art Academy of Cincinnati.

While she has chosen to stay in the area and attend the Art Academy of Cincinnati, her work is already receiving wider attention. She was a regional finalist in the Ohio Governor’s Youth Art Exhibition, a regional Gold Key winner in the Scholastic Art and Writing Awards competition, and a two-time silver medalist in the Ohio SkillsUSA state competition for Advertising Art.

She said that her best memories of Live Oaks were in the Digital Arts and Design (DAAD) lab. “It’s like having a second family who cares for me and cheers me on, no matter what,” she said. She also gives credit to DAAD instructor Adam Schlosser. “The impact he has had on me as well as all his other students has been phenomenal.”

Flory will be profiled on the Ohio Department of Education website at http://ode.ohio.gov.

Adena Surgeon First in U.S. to Use New Shoulder Implant

Adena Medical Center in Chillicothe

Adena Health System hosted a live, international surgery simulcast to Germany and sites across the United States. Dr. Brian S. Cohen, an Adena orthopaedic surgeon and chair of Adena Bone and Joint, performed the surgery where he installed a state-of-the-art reverse shoulder implant in a 72-year old patient. Dr. Cohen is the first surgeon in the U.S. to implant the Arthrex Reverse Universe device into a patient since the implant was approved by the U.S. Food and Drug Administration on May 31, 2013.

Dr. Cohen, a respected orthopaedic surgeon, also teaches surgical orthopaedic techniques to other physicians. In addition, he contributed to the actual design of the new implant. “When I first saw the Arthrex Reverse Universe about five years ago, there were certain things that I felt – from doing the procedure – that were missing from the implant which were essential,” said Dr. Cohen. “Some of those changes have been implemented.”

The new device is more cost effective, and uses technology not previously available in reverse shoulder implants. This technology is expected to provide a better, longer lasting bond over time. Of his contributions, Dr. Cohen added, “It is nice when people take stock in what you believe is important in helping your patients have a successful outcome, and then to implement them into a prosthesis.”

Reverse shoulder implant surgery is intended to replace the ball and socket of the rotator cuff, giving the patient better range of motion. Following reverse shoulder implant surgery, the part of the human shoulder which once held the socket now holds the ball and vice versa. By reversing the components of the shoulder, the patient’s mobility is greatly improved and most often leads to a better quality of life after surgery.

The patient suffered a torn rotator cuff injury several years ago and had an extensive course of traditional treatments for pain and mobility. Over time, the tear evolved to the point it had become debilitating and impacted his quality of life. Reverse shoulder implant surgery is often necessary when a patient suffers a rotator cuff injury or joint degeneration.

A Fayette County Judge will go before the Ohio Supreme Court later this month after being accused of several counts of misconduct.

Fayette County Probate Juvenile Judge David B. Bender is accused of failing to notify a client of his April 2011 appointment to the juvenile court, failure to appoint new counsel to his client’s case, and choosing to turn down a settlement in a then-pending case when instructed to do otherwise, among several other alleged acts of misconduct.

According to documents obtained by Fayette Advocate, Bender is also accused of paying himself and several clients from an “IOLTA” account, also known as a lawyer’s trust fund, which allegedly violates professional rules of conduct for a lawyer.

He is also accused of violating “a manner that promotes public confidence in the independence, integrity and impartiality of the judiciary.”

Bender responded to the complaint in official court fillings denying the allegations. Our newsroom contacted Bender’s office, who declined to comment on the matter.

The Supreme Court has set a June 21 court date to hear the case.

South Carolina Vacation Business Agrees to Pay Nearly $15,000 to Ohio Consumers

Ohio Attorney General Mike Dewine

Ohio Attorney General Mike Dewine

Ohio Attorney General Mike DeWine today announced that International Vacation Services LLC of South Carolina has agreed to pay $14,823.54 in consumer restitution, plus $5,000 in costs, according to a recent agreement to resolve alleged violations of Ohio’s consumer laws.
“Ohioans should remember that if it sounds too good to be true — it probably is — and to exercise caution when responding to offers that they have a ‘won’ a free prize or trip,” Attorney General DeWine said. “We are glad that consumers in this case will receive the restitution they deserve.”
According to the agreement, International Vacation Services of Landrum, South Carolina advertised and sold discount travel packages to Ohio consumers. It mailed solicitations telling consumers they had won a free prize or trip and invited them to sales presentations at local hotels, but it failed to disclose that consumers had to listen to a sales presentation to receive the prize and failed to give consumers notice of their three-day right to cancel under Ohio’s Home Solicitation Sales Act.
The business will pay the restitution and costs in increments according to a payment plan spelled out in the assurance of voluntary compliance, which is an out-of-court settlement.
Attorney General DeWine offered consumers the following tips for entering into travel agreements:
  • Research the company’s reputation. Check complaints filed with the Attorney General’s Office and the Better Business Bureau.
  • Be prepared for high-pressure sales tactics. Before attending a sales presentation, develop a plan for handling aggressive sales pitches. For example, refuse to make a payment before taking the contract home to review.
  • Keep in mind that if you sign a contract outside a seller’s normal place of business, such as a hotel or your home, you generally have three business days to cancel the contract. Sellers are required to give you notice of this right.
  • Check the contract for specific terms and conditions. Make sure you understand the refund policy, and insist that the seller put any verbal promises in writing.
Consumers who believe they have been treated unfairly by a travel company, or any business, should file a complaint with the Ohio Attorney General’s Office at 800-282-0515 or www.OhioAttorneyGeneral.gov.

SSCC Theatre presents “Over the Tavern” July 26-28

TavernPoster2

SSCC Theatre proudly presents Tom Dudzick’s “Over the Tavern,” playing July 26-28 in the Edward K. Daniels Auditorium on Southern State Community College’s Central Campus, 100 Hobart Drive, Hillsboro. The Friday and Saturday performances begin at 7:30 p.m., while the Sunday matinee begins at 3:30 p.m.

“Over the Tavern” is a warm and hilarious look at family, growing up, and God. In that most idealized period of 20th-century America, the Eisenhower years of the 1950s, the Pazinski family has a lot going on in their cramped Buffalo apartment. The youngest of the bunch, 12-year-old Rudy (played by Matthew Waits), is a smart, wise-cracking kid who’s starting to question family values and the Roman Catholic Church. When Rudy goes up against the ruler-wielding Sister Clarissa (Hannah Hengler) and announces that instead of being confirmed he’d rather shop around for a more “fun” religion, all hell breaks loose.

“Over the Tavern,” directed by Rainee Angles, also features the talents of Stormi Bledsoe, Jarrett Fittro, Bryan Kessinger, Tori Kocher, and Masen Woodall. The production is stage managed by Kat Castle and Micaela Countryman, with production design by Rainee Angles and Abraham Martin, sound design by Benjamin Gullett, and costume design by Laura Martin. Fulfilling other crew positions are Brent Angles, Kelly Devine, Jenna Horick, Leslie Holmes, Mark Holmes, Emily Kessinger, Tina Kessinger, Bryce Nartker, Seth Potts, and Heather Washburn.

Tickets for “Over the Tavern” are on sale now, for only $6, by visiting www.sscctheatre.com. At the door, tickets are $8. Credit cards are accepted for online purchases and at the door. Seats for this production will be reserved, so it is recommended that tickets be purchased early.

Missing Fayette Co. Woman Found Murdered Decades Ago Finally Laid To Rest

The local woman who went missing and was later found murdered in Michigan has been laid to rest.

Diann Tatum, aged 28 at the time of her disappearance and  formerly of 107000 U.S. 35 Northwest in Fayette County, has been laid to rest after being murdered and her body dumped in Michigan in 1994.

She was reported missing by family members on October 25, 1988 after leaving Fayette County to travel to her parent’s home in Warren, Michigan but never arrived, according to Fayette County Sheriff Vernon P. Stanforth.

Her car, a 1986 Renault, was located at a motel in Cincinnati, Ohio. She was not registered at the motel where the vehicle was found.

A few days later, her husband, Peter Tatum, reported her missing. It wasn’t until five years later that her unidentified body would be discovered in an abandoned house in Michigan by two kids, according to statements released by the St. Clair County (Michigan) Sheriff’s Office.

The Times Herald in Michigan reports that at the time of the discovery, officials said the woman had been shot in the head.

“In August of 1994, the St. Clair County, Michigan Sheriff’s Office discovered the unidentified skeletal remains of a female, the victim of an apparent homicide,” Stanforth said.

Nancy Manter’s grandson, Brent, was one of the boys who discovered the remains. She told The Times Herald that she often wondered about the woman who was discovered.

“I wondered about her until this very day,” Manter told The Times Herald. “I just can’t believe this..it does give it a little bit of closure, but I imagine the parents, my god, how do they feel.”

According to Stanforth, the body was moved to a forensics lab for further analyses.

“As the St. Clair County Sheriff’s Office continued their investigation, the skeletal remains were moved to the Michigan State University Anthropology Unit for further examination.”

In March of 2013, genetic data from Tatum’s family members and the skeletal remains were entered into a national DNA database called CODIS (Combined DNA Index System).

Almost instantly after being entered, a match was made and dental records confirmed it. The body was Diann Tatum.

“In April of 2013, a dental records comparison between Diann Tatum and the skeletal remains was conducted by the St. Clair County, Michigan Medical Examiner’s Office where it was determined that the skeletal remains discovered were those of Diann Tatum,” Stanforth said.

Tatum was laid to rest on July 8 in Clinton Township, Michigan. She was cremated and her ashes were given to family members stretching from Las Vegas, through Ohio and into Michigan.

The investigations are ongoing into her disappearance and murder.

Motorist Becomes Trapped Over Live Power Lines

Mid-afternoon storms rolled throughout central Ohio Wednesday evening.

Much of the state sustained mild damage when heavy winds blew through but Fayette County seems to have been spared from the worst.

Strong winds gusting at over 90 miles per hour were recorded in some parts of the county but authorities say the worst they were dealing with were numerous reports of trees down across roads.

On U.S. 41 winds brought down a power pole and lines were down across the highway. A female motorist failed to see them and drove over the wires. She remained in her car trapped until emergency crews arrived on scene; she wasn’t injured.

Despite other parts of the state reporting thousands of dollars in damage, authorities locally said that Fayette County is lucky.

In Columbus several roofs reportedly collapsed, and the Ohio State Football Stadium’s scoreboard sustained damage when part of the screen fell.

The area remained under a severe weather alert for much of the evening.

Two people were seriously injured Monday night after a car crashed through a wooden fence in Washington Court House.

Emergency crews responded to the intersection of Peddicord Avenue and Grace Street shortly after 11 p.m. after a neighbor in the area called 9-1-1 to report a car had ran a stop sign and crashed through a fence.

“I was sitting here talking to my girlfriend…dude came flying down the street and didn’t stop. He went right through the stop sign,” said Steve Brown, who lives on Grace Street. “Boom! He crashed right through that wall. I stood on my porch and people were getting out of the car and holding each other.”

Brown called 9-1-1 and reported the accident.

Crews arrived on scene and transported the underage driver to Fayette County Memorial Hospital where they were later flown to a trauma level hospital. An underage passenger was also transported to the hospital.

Significant damage was caused to the fence, which is owned by Jones’ Garage.

No other injuries were reported.

The names of those involved were not immediately released.
